23.2 Binding Individual Arbitration
Except where prohibited by law, disputes arising from or relating to these Terms, the website, the Service, advertising, communications, or purchases from Paddock Dream will be resolved through binding individual arbitration rather than through a court proceeding.
Arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, unless the parties agree to another recognized arbitration provider.
The Federal Arbitration Act will govern the interpretation and enforcement of this arbitration agreement.
The arbitrator may award the same individual remedies that would be available in court, subject to these Terms and applicable law.
Nothing in this section prevents either party from bringing an eligible individual claim in small-claims court.
Nothing prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction where necessary to prevent immediate and irreparable harm.
23.3 No Jury Trial
To the extent permitted by applicable law, you and ECOMGMD waive the right to have covered disputes decided by a judge or jury in court.
23.4 Class-Action Waiver
To the extent permitted by law, disputes must be brought only on an individual basis.
Neither you nor ECOMGMD may bring or participate in a class action, collective action, consolidated action, representative action, or private-attorney-general action concerning a covered dispute.
An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.
23.5 Arbitration Opt-Out
You may opt out of the binding-arbitration and class-action-waiver provisions by sending an email to hello@paddockdream.com within 30 days after first accepting these Terms.
Your opt-out notice must include:

Opting out of arbitration will not affect the remaining provisions of these Terms.

Where arbitration does not apply, has been validly opted out of, or is found unenforceable, disputes will be subject to the state or federal courts with jurisdiction in New Mexico, unless mandatory consumer law gives you the right to bring a claim elsewhere.
You and ECOMGMD consent to the personal jurisdiction of those courts where legally permitted.
SECTION 24 — PROMOTIONS, DISCOUNTS, AND FREE GIFTS
Paddock Dream may offer promotions, discount codes, bundles, free gifts, limited-time pricing, free products, or “buy more, save more” offers.
Promotions may be subject to separate conditions displayed on the website, product page, advertisement, cart, or checkout.
Unless expressly stated otherwise:

Before submitting a chargeback or payment dispute, customers should contact us at hello@paddockdream.com so we can attempt to resolve the issue.
Submitting a knowingly false, misleading, or abusive chargeback may constitute a violation of these Terms.
We may provide payment processors and financial institutions with relevant order records, tracking details, correspondence, website logs, and acceptance records when responding to a payment dispute.
Nothing in this section limits any legitimate right you have to dispute unauthorized or improper charges.
SECTION 27 — EVENTS OUTSIDE OUR CONTROL
We will not be liable for delay or failure caused by events outside our reasonable control, including:
