Throughout the website, the terms “Paddock Dream,” “ECOMGMD,” “we,” “us,” and “our” refer to ECOMGMD and the Paddock Dream online store.

This license does not transfer ownership of your content to us.

References to third-party vehicles, drivers, teams, championships, manufacturers, brands, or cultural subjects do not necessarily indicate sponsorship, authorization, endorsement, or affiliation unless expressly stated.

SECTION 16 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, we do not guarantee that:

• The Service will always be available, uninterrupted, secure, or error-free.

• Website errors will always be corrected immediately.

• Results obtained from using the Service will always be accurate or reliable.

This obligation will not apply where the claim was caused solely by our own unlawful conduct.

The unenforceable portion will be treated as separated from the remaining Terms.

We may suspend or terminate your access if we reasonably believe that you have violated these Terms, engaged in fraud or abuse, created legal or security risk, or failed to pay amounts properly due.

Obligations and liabilities incurred before termination will survive termination where appropriate.

Provisions relating to intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law will continue after termination.

SECTION 21 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and other policies expressly incorporated by reference, constitute the entire agreement between you and ECOMGMD concerning your use of the Service.

They replace prior discussions, communications, proposals, and agreements relating to the same subject matter.

A failure by us to enforce a provision does not constitute a waiver of that provision.

Any ambiguity in these Terms will not automatically be interpreted against the party that drafted them.

SECTION 22 — GOVERNING LAW

These Terms and any separate agreement under which we provide Services will be governed by the laws of the State of New Mexico and applicable federal laws of the United States, without regard to conflict-of-law rules.

Mandatory consumer-protection laws applicable in your place of residence may continue to apply where they cannot legally be excluded.

SECTION 23 — DISPUTE RESOLUTION, ARBITRATION, AND CLASS-ACTION WAIVER

23.1 Informal Dispute Resolution

Before initiating arbitration or court proceedings, you and ECOMGMD agree to make a reasonable good-faith effort to resolve the dispute informally.

You must send a written notice containing:

• Your contact information.

• Your applicable order number.

• A description of the dispute.

• The resolution you are requesting.

We may send a dispute notice to the email or mailing address associated with your order or account.

The parties will have at least 30 days after receipt of the notice to attempt an informal resolution.

23.2 Binding Individual Arbitration

Except where prohibited by law, disputes arising from or relating to these Terms, the website, the Service, advertising, communications, or purchases from Paddock Dream will be resolved through binding individual arbitration rather than through a court proceeding.

Arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, unless the parties agree to another recognized arbitration provider.

The Federal Arbitration Act will govern the interpretation and enforcement of this arbitration agreement.

The arbitrator may award the same individual remedies that would be available in court, subject to these Terms and applicable law.

Nothing in this section prevents either party from bringing an eligible individual claim in small-claims court.

Nothing prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction where necessary to prevent immediate and irreparable harm.

23.3 No Jury Trial

To the extent permitted by applicable law, you and ECOMGMD waive the right to have covered disputes decided by a judge or jury in court.

23.4 Class-Action Waiver

To the extent permitted by law, disputes must be brought only on an individual basis.

Neither you nor ECOMGMD may bring or participate in a class action, collective action, consolidated action, representative action, or private-attorney-general action concerning a covered dispute.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.

23.5 Arbitration Opt-Out

You may opt out of the binding-arbitration and class-action-waiver provisions by sending an email to hello@paddockdream.com within 30 days after first accepting these Terms.

Your opt-out notice must include:

• Your full legal name.

• The email address used for your order or account.

• Your mailing address.

• A clear statement that you wish to opt out of the arbitration agreement contained in the Paddock Dream Terms of Service.

Opting out of arbitration will not affect the remaining provisions of these Terms.

23.6 Court Jurisdiction

Where arbitration does not apply, has been validly opted out of, or is found unenforceable, disputes will be subject to the state or federal courts with jurisdiction in New Mexico, unless mandatory consumer law gives you the right to bring a claim elsewhere.

You and ECOMGMD consent to the personal jurisdiction of those courts where legally permitted.

SECTION 24 — PROMOTIONS, DISCOUNTS, AND FREE GIFTS

Paddock Dream may offer promotions, discount codes, bundles, free gifts, limited-time pricing, free products, or “buy more, save more” offers.

Promotions may be subject to separate conditions displayed on the website, product page, advertisement, cart, or checkout.

Unless expressly stated otherwise:

• Promotions cannot be combined.

• Discounts apply only during the advertised period.

• Discounts do not apply retroactively.

• Free gifts are subject to availability.

• Free gifts may not be exchanged for cash.

• Free gifts may not qualify for separate refunds.

• Discount codes must be entered before checkout is completed.

• A promotion may exclude selected products, collections, countries, or customers.

• We may limit promotions to one use per customer, account, household, payment method, or address.

• The lowest-priced eligible product may receive the discount in multi-buy offers.

• Shipping, taxes, and customs charges may remain payable.

We may cancel, modify, extend, or end a promotion where permitted by law.

We may reject promotional claims associated with fraud, duplicated accounts, automated purchasing, unauthorized resale, refund abuse, or manipulation of promotion mechanics.

If an order no longer satisfies the conditions of a promotion after a return or cancellation, the value of the retained products, discounts, or free gifts may be recalculated where permitted by law.

SECTION 25 — GIFT CARDS AND STORE CREDIT

Gift cards and store credit, where offered, are subject to any additional conditions disclosed when issued or purchased.

Unless required by law:

• Gift cards cannot be exchanged for cash.

• Gift cards cannot be used to purchase other gift cards.

• Lost, stolen, or improperly accessed gift cards may not be replaceable.

• Store credit is non-transferable.

• Promotional credit may expire according to the terms of the promotion.

Gift cards remain subject to applicable unclaimed-property, expiry, and consumer-protection laws.

SECTION 26 — CHARGEBACKS AND PAYMENT DISPUTES

Before submitting a chargeback or payment dispute, customers should contact us at hello@paddockdream.com so we can attempt to resolve the issue.

Submitting a knowingly false, misleading, or abusive chargeback may constitute a violation of these Terms.

We may provide payment processors and financial institutions with relevant order records, tracking details, correspondence, website logs, and acceptance records when responding to a payment dispute.

Nothing in this section limits any legitimate right you have to dispute unauthorized or improper charges.

SECTION 27 — EVENTS OUTSIDE OUR CONTROL

We will not be liable for delay or failure caused by events outside our reasonable control, including:

• Natural disasters.

• Severe weather.

• Fire or flooding.

• War, terrorism, or civil unrest.

• Epidemics or public-health emergencies.

• Government action.

• Customs restrictions.

• Labour disputes.

• Carrier interruptions.

• Manufacturing disruptions.

• Internet or telecommunications failures.

• Cyberattacks.

• Power outages.

• Supply-chain shortages.

Where such an event materially affects an order, we will take commercially reasonable steps to communicate with you and provide any remedy required by applicable law.
